The wife of the petitioner has been suffering from jaundice and her condition has been improving satisfactorily as per the medical opinion copy submitted on record. The treatment papers respecting Sohail, son of the petitioner, after suffering fracture, as per record pertaining to Safdarjung Hospital where the child was eventually taken, do not show any surgical procedure to be undertaken as is the ground to seek anticipatory bail. The petitioner is facing trial on the accusations for offence under Section 21 of Narcotics Drugs and Psychotropic Substances Act, 1985 (NDPS Act) for the possession of 300 grams of heroin. Having regard to this fact and the restrictions contained in Section 37 of NDPS Act, 1985, no case for interim bail is made out. Dismissed.
