% 23.08.2017 Respondent no.1 has positive instructions in the matter. He submits that he does not wish to file a counter affidavit. Record shows that the petitioner institute had sought accreditation from respondent no.2 and subsequent affiliation from respondent no.1. The document at page 24 of the paper book has been highlighted. Learned counsel for petitioner candidly admits that aforenoted document is dated 15.12.2016. His case has not been recommended due to non-submitting of electric power meter sealing report and the electricity bills. Additional submission is that on 21.12.2016 respondent no.1 sent a clarificatory e-mail to the petitioner that his papers showing that the electricity power meter have yet not been uploaded. Contention of the petitioner is that he has received no response from the respondents. Submission is that all documents have been submitted to
respondent no.1 but his case was not being processed by the said respondent.
At the outset, learned counsel for respondent no.1 had made a submission that there is no need to file a counter affidavit as this petition can be disposed of in terms of the positive instructions which he has. Respondent no.1 informs this Court that pursuant to the scrutiny of the documents aforenoted the case of the petitioner was examined by the Sub-Committee of respondent no.1 on 25.7.2017 and the case of the petitioner had been rejected. He could not be considered for the purpose of affiliation as deficiencies/lacunae were present. It is further pointed out that this communication has been uploaded on the website of respondent no.1.
This petition is now not maintainable in view of the fresh development which has taken place. Petitioner is advised to take appropriate steps in terms of the said rejection order dated 25.07.2017.
Petition disposed of in the above terms.
