% 24.05.2017 This petition is filed under Section 9 of the Arbitration and Conciliation Act, 1996 seeking injunction to restrain respondent No.1 from invoking/encashing the bank guarantee issued from respondent No.2/Canara Bank for Rs.36,03,00,000/-.

Learned counsel appearing for the parties accept that the bank guarantee has been encahsed and respondent No.2/Canara Banka has already transmitted the funds to respondent No.1 on 22.05.2017. In view of the above, learned senior counsel appearing for the

petitioner submits that he would like to withdraw the present petition with liberty to take remedial measures as available in law. The petition is dismissed as withdrawn with the aforesaid liberty. All pending applications also stand dismissed. JAYANT NATH, J MAY 24, 2017 rb
