Petitioner had filed a suit for recovery of Rs. 2,85,000/- as arrears of rent. It was filed against two defendants i.e. M/s J.J. Sokhi Industries (Tools) Pvt. Ltd. & Mr. Jugjivan Singh Sokhi, its Director. 2.
During pendency of the aforesaid suit, one Kewal Krishan Gupta moved an application under Order I Rule 10 CPC and noticing that he was also a necessary party, learned Trial Court, vide order dated 12.02.2016, allowed his application and impleaded him as one of the defendants in the aforesaid suit.

Such order is under challenge.

However, when asked as to what was the present status of the said suit, Mr. Garg, learned counsel for petitioner, in all fairness, admitted that aforesaid suit had been dismissed on 02.02.2022 by the learned Trial Court. 5.

dismissal of the suit and his appeal is pending adjudication before the concerned Court of learned District Judge.

In view of the above, present petition does not survive anymore as main suit has been dismissed by the learned Trial Court. 7.
Present petition is accordingly disposed of as having become infructuous. However, since appeal has already been filed against the dismissal of the suit, petitioner herein would be at liberty to raise his grievance, as taken herein, before the learned Appellate Court.
