The present matter has been received on transfer from another Bench. 2.

We are inclined to issue rule in the present petition. 3.

However, Mr. Bhardwaj, learned counsel for the petitioner states on instructions that instead of pressing the present petition any further, the petitioner may be granted liberty to assail the order dated 01.4.2015, passed by the Lt. Governor, Delhi, the Disciplinary Authority, before the Appellate Authority i.e., President of India. He states that while doing so, the petitioner reserves her right to refer to the O.M. dated 23.9.2016, issued by the Govt. of NCT of Delhi.

Leave, as prayed for, is granted. The petition is disposed of. 5.

As and when the petitioner files an appeal, the same shall be considered and disposed of, in accordance with law. The petitioner's appeal W.P.(C) 9215/2016

shall not be rejected on the ground of delay and laches, as she had assailed the order dated 01.4.2015, passed by the Disciplinary Authority by filing an original application before the Tribunal, which was decided on 26.2.2016, followed by an order dated 01.9.2016, dismissing her review application whereafter, she filed the present petition in the month of September, 2016 itself.
