% 24.07.2017 The present petition has been filed seeking quashing of FIR No.404/2015 dated 14.05.2015 (P.S. Dwarka South) instituted for offences under Sections 354A/506/509 of the IPC.
Earlier the petitioners had come up before this court vide W.P.(Crl.) 1410/2015 with the same prayer. During the hearing of the aforesaid petition, a statement was made on behalf of the State that a report under Section 173 Cr.P.C. has been filed in the subject FIR wherein the petitioners have only been kept in Column No.12 because of paucity of sufficient materials/evidence against them to be put on trial. In view of such statement, the W.P. (Crl.) 1410/2015 was withdrawn.
Mr. Ramesh Gupta, learned Senior Advocate submits that the report is pending before the concerned court but no order has been passed as yet, either accepting the report or otherwise.
This court has been informed that the next date before the concerned court is on 02.08.2017.
It is expected that on the next date, the learned court shall take a decision over the report submitted under Section 173 Cr.P.C. With this observation, this writ petition is disposed of. Dasti.
