After arguments and at the stage of dictation of the judgment, learned counsel for the appellants states that the appeal be disposed of as not pressed but appellants be granted time to vacate the suit premises. It is prayed that the appellant no.3 is a minor and appellant no.2 is just about 19 years of age and since are studying, sufficient time be granted to vacate the suit premises.

Accordingly, while disposing of the appeal as not pressed appellants are granted time to vacate the suit premises on or before 31.12.2018 subject to the appellant no.1 filing on her behalf and on behalf of the appellant no.3 an affidavit of undertaking to vacate the suit premises on
or before 31.12.2018 within a period of two weeks from today in this Court. Similar affidavit be filed by the appellant no.2. Appellants will also in the affidavits of undertakings undertake to pay charges towards electricity and water dues till the time the appellants will be in possession of the suit premises.

Appeal is accordingly disposed of and the appellants are granted time to vacate the suit premises on or before 31.12.2018 subject to the appellants filing the affidavits of undertakings as stated above and complying with the terms of the same.
