O R D E R

% 27.09.2017 Pursuant to the last order, the petitioner has filed the documents. The grievance of the petitioner is against his deployment as OSD to Secretary, Electricity Ombudsman. According to him, having been appointed in Delhi Electricity Regulatory Commission he could not have been posted as OSD. He concedes to the fact, in terms of the agreement executed between him and the DERC, his appointment is for a period of three years which is going to expire on September 30, 2017. He would state, on August 8, 2017 he had applied for extension of his appointment as Joint Director (Tariff-Eng.). Unfortunately, the same has not been decided till date.

Ms. Pratima Gupta, Adv. who appears for respondent no.2 would

state, the respondent no.2 is not replacing the services of the petitioner as Joint Director (Tariff-Eng.) by any other person. She also states the respondent no.2 has not advertised the said post. According to her, as and when respondent no.2 advertise the post of Joint Director (Tariff-Eng.), the petitioner shall be within his right to apply for the post. Noting the aforesaid submission of the learned counsel for the respondent No.2 and the fact that the appointment of the petitioner is coming to an end on September 30, 2017, the challenge of the petitioner against his deployment as OSD with Secretary, Electricity Ombudsman would be infructuous.

In view of the above, this Court is of the view, no relief, as prayed for can be granted in this petition.

The petition is dismissed.
