The petitioner has filed the present petition, inter alia, praying as under:- "a) pass a writ, order or direction in the nature of writ of declaration thereby declaring the act of the Respondents in showing the accounts of M/s Jindal India Thermal Power Ltd. in the CIBIL as individual accounts of the Petitioner as being illegal and arbitrary;

b) pass a writ, order or direction in the nature of writ of mandamus thereby directing the Respondents to correct the CIBIL Report/Records of the Petitioner on the website maintained by the Respondent No.2; "

The petitioner is essentially aggrieved by the reports submitted by respondent no.1 (hereafter 'Dena Bank') to respondent no.2 (Trans Union CIBIL Limited - hereafter 'CIBIL') as a consequence of which CIBIL has reflected certain bank accounts of M/s Jindal India Thermal Power Ltd as an

individual bank accounts of the petitioner.

The petitioner states that he was a Non-Executive Independent Director on the board of M/s Jindal India Thermal Power Ltd. during the period 25.05.2015 to 05.09.2017. He had neither furnished any undertaking nor stood as a guarantor for the loans advanced by Dena Bank to M/s Jindal India Thermal Power Limited.

The accounts of M/s Jindal India Thermal Power Ltd. with Dena bank have been declared as NPA. The learned counsel appearing for the Dena Bank readily concedes that the bank accounts in question are not the individual bank accounts of the petitioner. He further submits that the necessary communication for carrying out the correction would be sent to CIBIL.

In view of the above, the present petition is allowed. CIBIL is directed to forthwith carry out the necessary corrections on the basis of the averments made in the present petition. The Dena Bank shall also send the necessary communication to CIBIL in this regard. VIBHU BAKHRU, J SEPTEMBER 05, 2018 pkv
