By this petition the petitioner seeks anticipatory bail in case FIR No. 214/2016 under Sections 498A/406/34 IPC registered at PS Mukherjee Nagar, Delhi on the complaint of Kanika Verma. 2.

The allegations of the complainant in the FIR in question in nutshell are that she was mentally and physically harassed in relation to dowry by the petitioner and his family members. It is the case of the complainant that a huge sum of money was spent in the marriage and ₹12 lakhs was given to her in-laws for furniture and other household articles itself. Despite having given sufficient jewellery articles, the family members of the petitioner were not satisfied and they made demands of BMW or Audi and further jewellery. BAIL APPLN. 2021/2016

During the pendency of the present petition, learned counsel for the petitioner submitted that the items received by the petitioner's family as per para-4 of the additional affidavit were in their possession. Learned APP for the State informs that the same have been handed over to the complainant. To show his bona fide the petitioner has also deposited a sum of ₹2 lakhs with the Registrar General of this Court which has been kept in a fixed deposit.

Considering that the petitioner has shown bona fides by depositing ₹2 lakhs and handing over part items of streedhan and that the trial will take some time, this Court deems it fit to grant anticipatory bail to the petitioner. It is, therefore, directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that the petitioner will not leave the country without prior permission of the court concerned and in case of change of residential address the same will be intimated to the Court concerned by way of an affidavit.
