On the last date of hearing, Mr. Mohinder Nath Dudeja, Advocate had appeared on behalf of respondent and sought time to file a reply to the petition. The matter was adjourned at his request and the Trial Court Record was summoned in the meantime.

Trial Court Record has been added. However, Mr. Dudeja, Advocate states that despite his repeatedly making telephonic calls to his colleague, Mr. Rana, who had requested him to enter appearance in this matter on behalf of the respondent, none had contacted him. He therefore seeks discharge from the case. As the respondent is present in person, Mr. Dudeja is discharged.

On the first call, at the request of Mr.Rana, Advocate, who was also present in the Court, but was not in uniform, the matter was passed over. On

the second call, Mr. Rana, Advocate is absent. Instead, Mr. S.S. Bagga, Advocate seeks to enter appearance on behalf of the respondent. Power of attorney on behalf of the respondent shall be filed during the course of the day.

Having heard the submissions made by the learned APP, we are of the opinion that it is a fit case where leave ought to be granted to the State. Ordered accordingly.

The Registry is directed to register the present matter as a criminal appeal and assign it a number.

Trial court record has been added. The compilation of the trial court record once prepared by the Registry, shall be collected by the learned counsel for the parties.

The respondent shall furnish a bail bond for a sum of Rs.25,000/- alongwith a surety of the like amount. List this matter for the said purpose before the Joint Registrar (Judicial) on 26.03.2019. 6.

The respondent shall inform the local police in the event of change of his residential address. He shall also furnish his mobile number which shall remain active at all times.
