W.P.(C) 10699/2018 & CM APPL.41675/2018 (Directions) The present petition under Article 226 of the Constitution of India seeks a direction to the Directorate of Education to ensure that, a seat is allotted to the petitioner's minor son namely, Master Mohd. Azim the in preprimary class for the academic session 2018-19, under EWS category in Max Fort School, located in Paschim Vihar, New Delhi. Issue notice.
Ms. Manogya Singh, learned counsel accepts notice on behalf of respondent No.1. Mr. Jawahar Raja, learned Additional Standing Counsel accepts notice on behalf of respondent Nos.2 to 4. W.P.(C) 10699/2018
It is an admitted position that, failure to allot the seat under the EWS category by the respondent No.1 school is a subject matter that is within the ambit and jurisdiction of the Directorate of Education. Learned counsel appearing on behalf of the petitioner states that, they have already approached the Directorate of Education by way of a representation dated 15.09.2018 in this behalf. The said representation filed on behalf of the petitioner has not yet been processed, in accordance with law In view of the foregoing, the Directorate of Education is directed to take appropriate action, in accordance with law, on the representation filed on behalf of the petitioner within seven working days from today, under intimation to the latter. No further directions are called for in the present petition.
With the above directions the petition is disposed of. The pending application also stands disposed of.
A copy of this order be given dasti under the signature of Court Master to counsel for the parties.
