% 02.01.2018 I.A.No.11819/2017 (delay) This is an application seeking condonation of delay in re-filing of the petition.

For the reasons stated in the application, the delay is condoned and the application is allowed.

ARB.P. 643/2017 This petition under Section 11 of the of the Arbitration & Conciliation Act, 1996 (hereinafter referred to as the 'Act') has been filed seeking appointment of a sole Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the work awarded to the petitioner pursuant to the NIT-01/2012-2013 dated 06.07.2012 titled as "Segregation of the lift lobby from the other part of the building through Fire Smoke check Door at Udyog Sadan Building at Patparganj Industrial Area". Learned counsel for the respondent had handed over a list of Arbitrators that are on its panel. The petitioner has given its agreement for

appointing Mr.S.B.Jhamb as the Sole Arbitrator for adjudicating the disputes that have arisen between the parties.

I, accordingly, appoint Mr.S.B.Jhamb, 252, Nilgiri Apartment, Alaknanda, New Delhi, email- sbjhamb@yahoo.com as a Sole Arbitrator for adjudicating the disputes that have arisen between the parties. The Arbitrator will give disclosure in compliance with Section 12 of the Act before entering reference.

The Arbitrator would be paid fee as has been determined by the respondent for the Arbitrators on its panel.

A copy of the order would also be communicated by the petitioner to the Arbitrator.

The petition is allowed in the above terms.
