1. It appears that the mediation has failed.

2. The parties are agreeable to the Court appointing a sole Arbitrator for adjudication of their disputes.

3. It is ordered that a Sole Arbitrator be appointed to adjudicate the disputes between the parties, including their claims and counter-claims. The arbitration shall take place under the aegis of the Delhi International Arbitration Centre ('DAC').

4. The parties will appear before the DAC on 29th March, 2017 at 11:00 am for further steps in this regard.

5. The petition is disposed of. A copy of this order be sent to the Additional Coordinator, DAC forthwith.
