Transfer, under Section 24 of the Code of Civil Procedure, 1908 (CPC), is sought of CS No.75/2016 titled Virender Nehra Vs. Anju Singhal stated to be pending in Tis Hazari Courts, Delhi to Dwarka District Courts. 2.

Notice of the petition was ordered to be issued and the counsel for the respondent appeared on 9th May, 2017 and sought time to file reply. 3.

Reply has been filed opposing the transfer.

The counsel for the petitioner seeks time to file rejoinder. 5.

She also states that she has not received the reply. 6.

Transfer Petitions are not to be kept pending in this fashion. 7.

The counsel for the petitioner has not even bothered to disclose in the petition the Court before which the suit is pending in the Tis Hazari Courts, Delhi and though appearing today, is clueless in this regard. 8.

The counsel for the respondent also does not know anything about the matter.

A reading of the petition does not disclose any ground for transfer. Pending suits are not required to be transferred even if there is a change in territorial jurisdiction.
