Exemption allowed subject to just exceptions. C.M. stands disposed of.

+W.P.(C) No.9142/2016 2.

Counsel for the respondent no.2/school has placed on record copy of minutes of Review DPC dated 13.2.2017 as per which petitioner has

been held eligible for the post of Principal on account of her ACRs being very good for the past five years. Review DPC has also referred to the order passed in LPA No.99/2015 filed by the present petitioner wherein it is stated that since the petitioner has retired on 28.2.2015, petitioner's candidature would be considered for the post of Principal and if the petitioner is selected then notional benefits would accrue to the petitioner. 3.

Accordingly, the Review DPC dated 13.2.2017 has rightly appointed the petitioner to the post of Principal and has directed giving of notional benefits to the petitioner i.e petitioner's terminal benefits will be calculated as if petitioner stood promoted to the post of Principal of the respondent no.2/school.

Copy of the minutes of the Review DPC dated 13.2.2017 has been handed over to the petitioner who is present in person. 4.

In the present writ petition, petitioner had sought the relief of quashing of Review DPC dated 11.4.2016 for the post of Principal in the respondent no.2/school and since now that relief stands satisfied in view of Review DPC meeting dated 13.2.2017, hence taking on record the decision of the Review DPC dated 13.2.2017, this writ petition is accordingly disposed of.

5.

Respondents will release the monetary benefits which would be available to the petitioner in terms of the decision of the Review DPC dated 13.2.2017 within a maximum period of three months from today. Respondent no.1 will release the necessary finances to the respondent no.2/school and respondent no.2/school will thereafter pay amounts to the petitioner.

6.

Writ petition is disposed of in terms of aforesaid observations. VALMIKI J. MEHTA, J FEBRUARY 15, 2017 Ne
