Both the defendants have been served on 21.10.2018. They have filed their response to the suit of plaintiff on 19.12.2018. For the reasons stated in the application and submissions advanced by learned counsel for both the parties, delay in filing of written statement by defendants 1 & 2 is hereby condoned, in the interest of justice.

Written statement and affidavit for admission/denial of documents already filed by defendants 1 & 2 is

directed to be taken on record.

IA stands disposed of.

CS(OS) 496/2018 Defendant No.3 remained unserved. Summons issued to defendant No.3 returned back unserved with report that " she does not reside at the given premises". Let fresh steps for service of defendant No.3 by all permissible modes be taken by plaintiff within a week, returnable for next date of hearing, with direction to defendant No.3 to file her response to the suit of plaintiff within thirty days from the date of service of summons.

Let replication to the written statement of defendants 1 & 2 alongwith affidavit for admission/denial of documents be filed by plaintiff within four weeks with advance copy to counsel for defendants.
