% 03.08.2017 RFA 473/2017 & C.M. No. 17201/2017 (Stay) In this appeal the notice was issued and accepted by counsel for the respondent, the parties agreed to settle the matter and the respondent was directed not to take any coercive steps against the appellant.

It has been stated by counsel appearing on behalf of the appellant that the matter was taken up before the Delhi High court Mediation and Conciliation Centre and ultimately the parties have finally arrived at a settlement. Report of Mediation and Conciliation Centre dated 17.07.2017 has already been filed on the record. It is stated by counsel for the appellant, on instructions, that the settlement arrived at before the Delhi High court Mediation and Conciliation Centre is acceptable to the parties and pray for modification of the judgment and decree passed by the trial court.

Settlement Agreement dated 17.07.2017 arrived at between the parties before the Delhi High Court Mediation and Conciliation Centre is already on record.

Considering the fact that the parties to the appeal have entered into a settlement before the Delhi High Court Mediation and Conciliation Centre, the judgment and decree dated 04.07.2016 passed by the learned ADJ is modified in terms of the settlement arrived at between the parties before the Delhi High Court Mediation and Conciliation Centre. Parties to the settlement are directed to remain bound by the terms of the settlement agreement. Terms of the settlement agreement shall remain part of the decree. Consequently, the appeal is disposed of in terms of the settlement arrived at between the parties. Decree sheet be prepared in accordance with the terms of the settlement agreement. The appeal stands disposed of accordingly.
