Petitioner impugns order dated 25.05.2018 whereby the application of the petitioner seeking dismissal of the suit as infructuous has been dismissed.

Subject suit was filed by respondent No.1 for recovery of possession and damages. Petitioner is the daughter of respondent No.1/ Mr.K.K.Sareen and respondent No.2(a) to 2(e) are the other children of Mr.K.K.Sareen.

Parties were referred to mediation. Settlement Agreement dated 06.11.2019 has been executed by the parties.

Petitioner and respondent No.2(a) and her brother, Sh.Ashwani Sareen, respondent C.R.P. 190/2018

No.2(a) are present in Court. The other parties are represented by their counsel.

Petitioner, respondent No.2(a) and the respective counsels for the parties confirm the Settlement Agreement and undertake that parties shall duly abide by the terms of the settlement. Settlement Agreement is accordingly taken on record.

In view of the settlement, learned counsel for the petitioner seeks leave to withdraw the petition.

Petition is accordingly dismissed as withdrawn. 7.

Parties shall remain bound by the terms and conditions of the Settlement Agreement dated 06.11.2019.
