% 12.01.2016 IA 498/2016 (u/O 23 Rule 1 CPC) This is an application filed by the plaintiff No.1, who also represents plaintiff No.2 in terms of General Power of Attorney executed by the plaintiff No.2 on October 29, 2015, under Order 23 Rule 1 CPC. It is averred in the application that the land belonging to plaintiff No.2 has been sold to third party. Learned counsel for the plaintiff clarifies that the same has been sold to defendant No.6.

Learned counsel for defendant Nos.1 to 3 has no objection on the withdrawal of the suit by the plaintiffs.

Be it noted that the defendant Nos.4 & 5 have not been appearing in

the proceedings.

In view of the aforesaid, the suit is dismissed as withdrawn. Application stands disposed of.
