% 06.12.2016 CM 45199/2016 (seeking withdrawal of present appeal in terms of settlement) This is a joint application moved by the parties for withdrawal of the present appeal in terms of settlement. The photocopy of settlement has been placed on record, according to which the matter has been amicably settled between the parties for a total sum of Rs.38 lacs which has been paid by the appellants to the respondent and thereafter the machines have been handed over to the appellants on 03.12.2016. The photocopy of receipt of Rs.38 lacs and handing over of machines and the original documents to the appellants has also been placed on record.

In view of the settlement arrived at between the parties, the appeal is dismissed as withdrawn.
