% 12.02.2018 CM No. 5376/2018 This is an application filed by the respondent No. 1 with the following prayers:
"It is, therefore, most respectfully prayed that the Hon'ble Court may kindly be pleased to dispose of the present writ petition as the continuance/pendency of the same might prejudice the case of the applicant/respondent No. 1 before the Hon'ble Appellate Tribunal".
It is not disputed that the respondent No. 1 Bhupinder Singh has, with respect to the properties bearing Nos. 5215, 5215-A & 5216 has filed four appeals being 979/2017, 980/2018, 1051/2017 and 1052/2017 against the
demolition orders and rejection of regularization of the properties before the A.T.M.C.D.
Learned counsel for the petitioner states, the petitioner would also implead/intervene in those appeals. Mr. Dutta, learned counsel appearing for the respondent No. 3 has no objection in that regard. Noting the statement made by the learned counsel for the petitioner, the petition is dismissed as withdrawn with liberty to the petitioner to seek impleadment/intervention in appeals before the Appellate Tribunal. I may take the statement made by the counsel for the respondent No. 1/applicant, on record, that he shall not oppose the impleadment/intervention of the petitioner in those appeals.
