The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.706/2016 registered under Section 376 IPC at PS Mukherjee Nagar. Status report not filed.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 21.09.2016. On completion of investigation, a charge-sheet has already been filed. The victim is aged around 30 years, mother of three children. The BAIL APPLN. 1056/2017

petitioner and the prosecutrix were acquainted with each other. After victim's husband deserted her, intimacy developed between the petitioner and the prosecutrix. Physical relations took place between the two on several occasions albeit on the alleged promise to marry. When the prosecutrix came to know that the petitioner was performing marriage somewhere else, the instant FIR was lodged. 3.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 40,000/- with one surety in the like amount to the satisfaction of the Trial Court. The petitioner shall not contact the complainant and shall not criminally intimidate her in any manner. 4.

The bail application stands disposed of.
