% 20.09.2016 Mr. Ajay Amitabh Suman, Advocate on instructions from Mr. S.K. Bansal, learned counsel for appellant, seeks permission not to press this appeal with liberty to argue fresh application under Order 39 Rules 1 & 2 of CPC before the trial court said to have been pending there for 13th October, 2016.

Learned counsel for respondent submits that it be clarified the order in this appeal would have no bearing on the merits of the fresh application under Order 39 Rules 1 & 2 of CPC pending before the trial court.

In view of the stand taken as aforesaid, this appeal and the application are dismissed as not pressed with clarification that dismissal of this appeal would have no bearing on the merits of the application pending before trial court.
