% 05.03.2018 By this petition, the petitioner seeks anticipatory bail in case FIR No. 21/2015 under Sections 7/13 of the Prevention of Corruption Act (in short 'PC Act') and Sections 420/467/468/471/120B IPC lodged at PS Anti Corruption Branch by the Delhi Police.
A complaint by one Tarun Kumar was received in the Anti Corruption Branch at helpline No. 1031 alleging that the petitioner while working in Saket Court was demanding bribe of ₹1 lakh. Thereafter the complainant gave his complaint in writing along with an audio CD, transcript of SMS as well as fake appointment letter purportedly issued by NDMC. BAIL APPLN. 1026/2017
It is the case of the complainant that the petitioner while posted at Saket Court demanded and accepted ₹3,50,000/- in lieu of getting a government job in NDMC or Court. It is alleged that the petitioner also obtained ₹70,000/- and ₹1,10,000/- from his friends Brijesh & Dinesh for securing a job for Brijesh's wife and Dinesh respectively, on the pretext that he knew many officer in the NDMC and thus could help in appointment. The petitioner even handed over appointment letter issued from NDMC, Palika Kendra which was later revealed to be not genuine. Considering the allegations against the petitioner and that the petitioner has already been declared a proclaimed offender by the Court on 31st November, 2015 in view of the decisions reported in 2012 (8) SCC 730 Lavesh vs. State (NCT of Delhi) and 2014 (2) SCC 171 State of M.P. vs. Pradeep Sharma, the present petition seeking anticipatory bail is not maintainable.
Petition is dismissed.
