% 16.07.2018 IA No. 8869/2018 This application is filed under Order 23 Rule 3 CPC seeking passing of a decree in terms of the settlement dated 01.06.2018. It has been pleaded that the parties have entered into a Memorandum of Family Settlement on 01.06.2015 which is signed by all the parties and respective witnesses. The terms and conditions of the settlement are spelt out in the application. The terms and conditions of the Memorandum of Family Settlement are legal and valid.
The parties, namely, Ms.Nishi Gupta, Ms.Anju Gupta and Mr.Sanjiv Mittal are personally present in court and undertake to abide by the terms and conditions of the Memorandum of Family Settlement.
The application is allowed.
CS(OS) 258/2017 A decree is passed in terms of the Memorandum of Family Settlement on 01.06.2018. The terms and conditions of the said settlement as stated in para 4(A) to 4(I) of the above application shall form part of the decree. The parties shall remain bound by the terms and conditions of the Memorandum of Family Settlement dated 01.06.2018. The suit stands dispose of.
