% 04.04.2018 It is submitted that FIR No.

27/2010 under Sections 420/468/471/419/120-B IPC was registered at Police Station Rani Bagh on the complaint of Late Shri Vijay Gupta (complainant). Respondent no. 6 Smt.

Shakuntala is wife of accused P.K. Tandon, who has since expired. Petitioner is also accused in the FIR. After investigation, charge-sheet has been filed. Disputes arose between Late Shri Vijay Gupta and deceased accused P.K. Tandon in respect of the property deal as detailed in the FIR. It is submitted that respondent no. 2 (son of complainant) has settled the matter with petitioner and respondent no. 6 of his own free will and without any undue force, pressure or coercion, vide Memorandum of Understanding dated 13th February, 2017,

therefore, aforesaid FIR and the consequent proceedings may be quashed. Respondent nos. 3 to 5 are sisters of respondent no.2 . They are other legal heirs of complainant Late Shri Vijay Gupta. They submit that they accept the aforesaid settlement and have no objection in case FIR is quashed. Respondent no. 2 says that the settled amount has already been received by him, therefore, he has no objection in case FIR is quashed, in view of the settlement. Keeping in view the settlement arrived at between the aforesaid parties voluntarily, I am of the opinion that no fruitful purpose would be served in keeping the criminal proceedings pending.

Accordingly, in the interest of justice, FIR No. 27/2010 under Sections 420/468/471/419/120-B IPC registered at Police Station Rani Bagh and consequent proceedings emanating therefrom are quashed.
