CRL.M.C. 3688/2016 This is a petition under Section 482 Cr.P.C. for quashing of FIR No. 409/2014, under Section 135 Indian Electricity Act (Amended), 2003 registered at Police Station Fatehpuri Beri. It is stated that the matter has been settled amicably between the parties.
Counsel for the petitioner submits that the petitioner has amicably settled the matter in dispute with the respondent No.2/BSES and the settle amount of Rs.1,85,000/- has already been deposited by the petitioner vide receipts No.040032063659 and 040032913757 dated 14th October, 2014 and 31st March 2016 respectively.
Counsel for the respondent No.2, on instructions, also confirms the factum of amicable settlement with the petitioner and submits that he has no objection if the FIR No. 409/2014 in question is quashed against the petitioner.
In view of the amicable settlement entered into between the parties, no useful purpose would be served in continuing with the criminal proceedings against the petitioner. Accordingly, the petition is allowed and the FIR No. 409/2014, under Section 135 Indian Electricity Act (Amended), 2003 registered at Police Station Fatehpuri Beri and all proceedings emanating therefrom are hereby quashed.
