After arguments, this appeal is disposed of with the consent order that without in any manner expressing any opinion on the merits of the suit, or as to whether the suit should continue at all and should not be dismissed or rejected at the initial stage, impugned order dated 14.2.2017 is set aside with liberty to the respondents/defendants to appear in the suit, file their written statement, take all other defences of facts and law and contest the suit in accordance with law. 2.

I may clarify that if the respondents/defendants feel that the suit is barred by law or the suit has to be dismissed at the threshold or the plaint rejected, it will always be open to the respondents/defendants to file an appropriate application in accordance with law after completion of pleadings.

Accordingly, the impugned order dated 14.2.2017 is set aside. Parties to appear before the District and Sessions Judge, Saket Courts, New Delhi on 21st December, 2017 and the District and Sessions Judge will mark the suit for disposal to a competent court in accordance with law.
