% 03.05.2018 After some hearing, the counsel for the petitioner submits that he may be allowed to withdraw the present petition and the application filed therewith and instead be given liberty to file a review application to point out that there is a factual error in the impugned order dated 28.07.2016, disallowing the application for amendment of the plaint, inasmuch as the prayer to seek declaration vis-a-vis Sale Deed dated 18.10.2011 which was registered on 14.11.2011 was within three years of the amendment application being filed in July, 2014, the petitioner seeking now to restrict the amendment only to that extent.

The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for granted. R.K.GAUBA, J.
