O R D E R

% 06.07.2017 This is an application under Section 438 Cr.P.C. filed on behalf of the petitioner for grant of anticipatory bail in case FIR No.0541/2016, under Sections 325/354/506/509/34 IPC, registered at Police Station Ambedkar Nagar, New Delhi.

Counsel for the petitioner has submitted that the petitioner is an innocent person having no nexus with the allegations as alleged in the FIR. Counsel further submits that the injured has already been discharged from the hospital and the petitioner is ready to join the investigation as and when directed to do so and prays that the petitioner may be released on anticipatory bail.

The complainant is present in person. Learned APP for the State opposes the grant of anticipatory bail to the petitioner and submits that the

petitioner is involved in one another FIR bearing No.396/2013 and the nature of the injury caused on the person of the injured is grievous. Looking into the aforesaid facts and circumstances, since the injured has already been discharged from the hospital, the petitioner is directed to join the investigation as and when directed to do so and in the event of his arrest, the petitioner be released on anticipatory bail, on his furnishing bail bond in the sum of Rs.25,000/- with one surety of the like amount, to the satisfaction of the Investigating Officer/SHO concerned with the condition that the petitioner shall not leave the country without the prior permission of the Court concerned and shall not tamper with the prosecution evidence and he shall not contact the complainant in any manner either telephonically or through other modes.

The present bail application is allowed and stands disposed of in the above terms.
