% 26.05.2017 Crl.M.A.9074/2017 Exemption allowed, subject to all just exceptions. The application stands disposed of.

W.P.(CRL) 1636/2017 Though the petitioner was granted parole by the competent authority by order dated 02.03.2017, but the parole was only for a period of two weeks which ends on 31.05.2017.

The petitioner has applied for extension of the aforesaid parole by his representation dated 19.05.2017 which has yet not been responded to. It has been pointed out on behalf of the petitioner that he was sentenced to undergo RI for 10 years and out of the aforesaid sentence, he has already undergone 5 years in custody. His conduct in jail has been

satisfactory. It has further been submitted that the aforesaid extension has been prayed for finding a suitable match for his daughter who is of marriageable age. The wife of the petitioner is said to be suffering from an auto immune disease called SLE. The petitioner also has to look after his old parents.

Taking into account the aforesaid facts particularly the good conduct of the petitioner in jail, the competent authority having released him for two weeks which presupposes that other conditions for grant of parole were satisfied and that the petitioner requires to remain out for two more weeks for settling the marriage of his daughter, this Court has been persuaded to modify the order of the competent authority dated 02.03.2017 and extend the parole for a further period of two weeks, to be counted from 31.05.2017. The other conditions imposed by the competent authority shall subsist. The petitioner shall now surrender on the end of the extended period of parole.

The order be communicated to the Superintendent of the concerned jail for compliance and record.
