% 05.10.2016 CRL.REV.P. 663/2016 and Crl. M.A. No. 15772/2016 (exemption) Learned counsel for the respondent/CBI submits that this revision petition has been filed against the order dated 11th August, 2016 passed by Special Judge, (PC Act) in coal allocation matters. She submits that coal allocation matters are being monitored by the Supreme Court and in Writ Petition (Crl.) No. 120/2012, it has been directed that any prayer for stay or impeding the progress in the investigation/trial can be made only before the Supreme Court and no other Court shall entertain the same. Learned counsel for the respondent further submits that filing of such revision petitions and

their proceedings would amount to impeding the trial. Learned Senior Counsel for the petitioner submits that he is not seeking stay in this case. Learned counsel for the respondent submits that similar questions relating to Sections 91/207/294 Cr.P.C., involved in the matter, are pending before the Supreme Court.

Learned Senior Counsel for the petitioner submits that, in view of the above statement of learned counsel for the respondent, petitioner would approach the Supreme Court for appropriate directions. He seeks leave to withdraw this petition.

Revision petition is disposed of as withdrawn. Miscellaneous application is disposed of as infructuous. A.K. PATHAK, J.
