BAIL APPLN. 1069/2017 The petitioner seeks release on anticipatory bail in the context of case FIR 506/2015 under section 364 IPC of police station Nabi Karim.

Status report filed.

It indicates that the petitioner has been absconding and was declared proclaimed offender by the concerned magisterial court by order dated 09.02.2016.

He had earlier approached this court for release on anticipatory bail by bail application no.277/2017 but chose to withdraw the same and the said petition was dismissed as withdrawn on 14.02.2017. He had also filed a criminal writ petition questioning the merits of the case against him, it being WP (Crl.) 2079/2016 which also was dismissed as withdrawn BAIL APPLN. 1069/2017

by order dated 24.11.2016.

His co-accused Ajay Sharma is also similarly absconding and his application for release on bail, it being bail application no.768/2017 was dismissed by this court on 28.04.2017.

The case involves abduction of a medical practitioner from Dibrugarh in Assam on 23.09.2015 from Delhi, he being released by the abductors on 05.10.2015 in the wake of pursuit by the police. As per the evidence, demand of ransom in the sum of Rs.5 Crores had been raised during the said period. The role of the petitioner has come up, inter alia, in the wake of statement of the victim recorded under Section 164 Cr. PC on 09.10.2015. Against this backdrop, there is no case made out for release on anticipatory bail.

Dismissed.
