% 11.01.2016 CM.APPL 31391/2015(rectification of order) Ms. Jyoti Singh, learned Senior Counsel for the petitioner submits that the order of 08.10.2015 be clarified to the extent that the petitioner would be allowed to place the written statement of defence under Rule 14(5) of CCS(CCA) Rules, which is a statutory right in favour of the petitioner. Notice. Mr. Bhdardwaj accepts notice.
Mr. Bhardwaj submits that the stage of filing written statement was lost in the year 2012 when the inquiry officer was appointed. In our view, we find no reason for any rectification in the order dated 08.10.2015 which has been passed. It is up to the petitioner to file the written statement of defence if the law so permits and if so advised. The application stands disposed of.
