% 23.10.2018 CM.APPL 39621/2018 (delay in filing the appeal) This is an application filed by the appellant seeking condonation of 96 days delay in filing the appeal.

Notice. Counsel for the non-applicant accepts notice. The prayer made in this application is not opposed. Accordingly, the delay of 96 days in filing the appeal is condoned.

The application stands disposed of.

MAT.APP.(F.C.) 240/2018 Challenge in this appeal is to the order dated 11.04.2018 by which the Family Court has directed the appellant herein to ensure that the minor child is admitted to a school in Delhi or Ghaziabad. The appellant who is present in Court is willing to furnish an unconditional undertaking that he would

comply with the order of the Family Court and admit the child in a school at Delhi or Ghaziabad as directed by the Family Court in the Academic Session of 2019.

The appellant is duly identified by his counsel. He (appellant) submits that he would not press the appeal but seeks indulgence of the Court that he may be permitted to comply with the order of the Family Court in the Academic Session of 2019, so that the education of the child is not disrupted.

Learned counsel for the respondent very fairly agrees to the submissions so made upon the appellant furnishing an undertaking to this Court, keeping in view the welfare of the child. In view of the stand taken by learned counsel for the parties, the appeal is dismissed as not pressed binding the appellant to the undertaking/statement made in Court which is accepted by the Court. The appellant has been informed about the consequences of breach of the undertaking furnished to the Court.

The appellant will sign the order in token of his acceptance. CM.APPL 39620/2018 also stands disposed of.
