% 18.01.2019 Vide the present petition, the petitioner seeks direction thereby setting aside the impugned order bearing Office Memorandum F.

No.

13016/9/2014-CA-III(Vol. III) dated 30.03.2017 in respect of the Jamkhani Coal Block, inasmuch as the said impugned order treats unequals of specified end-uses of "Iron & Steel", "Cement", "Captive Power Plants", as equal in breach of Article 14 of the Constitution of India, and Section 3(1)(v) and Section 7 of the Coal Mines Act.

Learned Standing Counsel appearing on behalf of the Union of India submits that a statement was made before the Division Bench in W.P.(C) 12686/2018 that the Union of India at present is withdrawing the tender for auction of the Jamkhani Coal Mines and accordingly, the aforesaid writ petition was dismissed as infructuous.

Learned Standing Counsel submits that the impugned order dated 30.03.2017 has been withdrawn as concerned to the mines in question in the present writ petition.

Thus, the present petition has become infructuous and accordingly dismissed being infructuous.
