% 22.08.2017 This execution petition has been filed under Section 36 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as 'the Act') seeking to enforce the award dated 15.06.2016. The learned senior counsel appearing for the judgment debtor pointed out that the invocation of the arbitration was prior to 2007 and hence, unamended provisions of the Arbitration & Conciliation Act, 2006 would be applicable and that the present execution petition is not maintainable at this stage as objection to the award being OMP(COMM.) 432/2016 are pending. In view of the above, the present execution petition is disposed of with liberty to the petitioner- Pearl Developers Pvt.Ltd. to take steps after adjudication of the petition under Section 34 of the Act, which is OMP (COMM) No.432/2016 as per law.
