% 08.08.2017 Respondent has positive instructions. His submission is that the Government Sarvodaya Co-Ed.Vidyalaya is ready to admit the petitioner/child in Class V which was also one of the prayers sought for in the present petition. Copy of this communication dated 01.08.2017 addressed by the Govt. Sarvodaya Co-Ed. Vidyalaya to the respondent No. 1 has been placed on record. A Copy has been furnished to the petitioner. She is satisfied with the submission of the respondent. The respondent is directed to admit the petitioner in Class V in the aforenoted school which also falls in the same locality where the petitioner is residing.
Respondent No. 3, at this stage, states that the report card of the petitioner/ child could not be released as the school fee amount to Rs. 67,000/- and odd has not been paid by the petitioner. Learned counsel
for the petitioner submits that the petitioner is not in a position to pay such a huge amount. Although the petitioner had been admitted in the school in the general category but he had been permitted by the school to study in Class IV hoping that respondent No. 3 would convert the status of the petitioner child from general to EWS category. This submission is refuted by respondent No. 3. The petition is disposed of with direction to the petitioner to approach respondent No. 3 with an appropriate application who shall consider the same sympathetically.
