% 27.11.2017 Petitioner approached this Court alleging unauthorised construction in property bearing No.29, Sandesh Vihar, Pitam Pura, New Delhi.
In the status report dated 23.11.2017, it has come to be stated as under:- ".............................................................................................. ........................................................................................... 3.
That action under Section 343/344 of the DMC Act has been initiated and the unauthorized construction in the shape of deviations from Sanctioned Building Plan have been booked vide file no.153/C63/B-II/UC/CLZ/2017 dt. 30.05.17 and after following the process of law including grant of personal hearing, speaking order under section 343 (1) of the DMC Act have been passed on 19.07.17 with the directions to Smt.
Anju, the present owner of the property to demolish the unauthorized construction/deviations/excess coverage within a period of six days.

That since, the owner/occupier failed to comply with instructions contained in the speaking orders, a demolition program was fixed on 01.08.17. During the action, covered area in the rear portion of the property was demolished at all floors i.e. stilt to third floor. Another demolition program was fixed on 17.11.17 and during the action three rooms in stilt parking were demolished. The photographs of the demolition actions are annexed herewith as Annexure-"A" (Colly). 5.
That a regularization application has been received from Smt. Anju, the owner of the property in question on 17.11.17.
The said application is under process and further action, if any, will be taken in due course of time after disposal of the regularization application."
In view of the steps taken and contemplated, ld. Counsel for the petitioner submits that the petition is not pressed any further. Petition along with pending application are disposed off in view of the steps taken and contemplated as also keeping in mind the statement made on behalf of the petitioner.
