By an order dated 01.12.2016, Mr Vijay Motwani, Former Special Director General of CPWD was proposed to be appointed as the Presiding Arbitrator since the Presiding Arbitrator appointed earlier has resigned. 2.

The matter was deferred awaiting his disclosure under Section 12 of the Arbitration and Conciliation Act, 1996. Further, the parties were granted liberty to approach the proposed arbitrator for obtaining the necessary disclosure.

The learned counsel for the petitioner submits that the arbitrator has since disclosed that he has no prior dealing or any relation with the parties and is not interested in the subject matter of the dispute. 4.

Accordingly, Mr Vijay Motwani, Former Special Director General of CWPD is appointed as the Presiding Director.

It is further directed that arbitral tribunal shall continue the proceedings from the same stage as obtaining when the earlier Presiding Officer had resigned.

The petition is, accordingly, disposed of.
