O R D E R

% 22.11.2017 By the present petition the petitioner seeks parole on the ground that he has to file the Special Leave Petition and re-establish ties. The petitioner was acquitted by the learned Metropolitan Magistrate, however on an appeal filed by the State the petitioner was convicted for offence punishable under Section 377 IPC and awarded a sentence of rigorous imprisonment for 5 years besides fine. On a revision petition filed by the petitioner being CRL.REV.P.173/2016 the conviction of the petitioner was upheld for offence punishable under Section 377 IPC, however the sentence was modified to imprisonment for a period of 3 years besides the fine. W.P.(CRL) 1650/2017

Considering the fact that this Court had passed the judgment in CRL.REV.P.173/2016 on 4th January, 2017 and in May the petitioner filed the present petition seeking parole and as per the nominal roll the petitioner is not involved in any other offence, this Court deems it fit to grant parole to the petitioner for a period of four weeks. It is therefore directed that the petitioner be released on parole on his furnishing a personal bond in the sum of ₹20,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/ CMM.

Petition is disposed of. Order dasti.
