dismissed on 17th September, 2013 and in respect of which LPA 195/2014 was filed, which was dismissed as withdrawn. Having regard to these circumstances, reagitation of the same grounds was entirely unjustified. This Court is of the opinion that the Single Judge has not faulted in imposing the costs, but at the same time the peculiar circumstances of this case, require mitigation. The impugned direction to pay the costs is hereby set aside. The appeal is accordingly disposed of.
