W.P.(C) 5183/2017 The issue with regard to revaluation or rechecking of the answer paper has been answered in negative and against the petitioner vide order dated 3rd October, 2016 in W.P. (C) No. 9131/2016. The petitioner cannot re-agitate and raise the same issue once again in view of the principle of res judicata.

The petitioner submits that after the aforesaid decision, the respondents had issued order dated 11th April, 2017, stating that there
were differences in totalling of marks in few cases and corrections have been made.

Counsel for the petitioner during the course of hearing has shown to us the answer paper of the petitioner. As per the said answer paper, the petitioner had secured 35.5 marks. The qualifying marks were 45. The petitioner, therefore, cannot be put in the same category as other cases, which were mentioned in the order dated 11th April, 2017.

The writ petition has no merit and is dismissed. SANJIV KHANNA, J.
