CRL.M.C. 3707/2016 By the present petition the petitioners, that is, Rajesh Kumar Anand, VInod Kumar Dhalla, who had been summoned for offences punishable under Sections 420/467/468/471/120B IPC in Complaint Case No. 244/1/05 titled as 'Vidhya Bhushan vs. Rajesh Anand & Ors.' seeks quashing of complaint and proceedings pursuant thereto on the ground that the parties have settled the matter.
The Respondent No. 2/complainant who is present in Court and is CRL.M.C. 3707/2016
identified by the learned counsel states that he was the only complainant in the above noted complaint and he has settled the matter with the Petitioners named above and he has no claims whatsoever against the petitioner. He also states that he does not want to pursue the abovementioned complaint and the proceedings pursuant thereto.
Petitioners who are present in Court and are identified by the learned counsel affirm the statement of respondent No.2 and state that they will abide by the terms of the settlement.
In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, rather the same would create further acrimony between them, it would be in the interest of justice to quash the abovementioned complaint and the proceedings pursuant thereto. There is no legal impediment in quashing the complaint case and the proceedings pursuant thereto in question. Consequently, Complaint Case No. 244/1/05 under Sections 420/467/468/471/120B IPC titled as 'Vidhya Bhushan vs. Rajesh Anand & Ors.' pending in the Court of learned CMM, Tis Hazari Courts, Delhi, order summoning the petitioners and proceedings pursuant thereto are hereby quashed.
Parties have signed this order sheet in acknowledgment of their statements made before this Court.
The petition is disposed of. Order dasti.
