% 07.10.2016 After some hearing, learned counsel for the appellant submits that he would be filing counter affidavit and an application seeking extension of time for deposit of arrears. The appellant states he will request for modification of the said order with regard to the future payment. He submits that the matter / dispute can be resolved and settled. We clarify that this Court has not expressed any opinion on the merits of the case and it will be open to the learned Single Judge to examine the counter affidavit and contention of the appellant in the applications.

In view of the aforesaid statement, the appeal stands disposed of. All issues are left open, if required and necessary to be raised after the

applications filed are disposed of.
