% 11.09.2018 By this petition, the petitioner seeks directions to the respondent to expedite the hearing of the petitioner's case by conducting regular/routine hearing in case FIR No. 471/2014 under Sections 498A/406/34 IPC registered at PS Civil Lines and to compel the presence of the accused persons on every date and directions to the respondent to conduct proceedings and any other order as deem fit. The respondent in the present petition is State, GNCT, through its Chief Secretary. Admittedly charge sheet has been filed on which cognizance has been taken by the learned Metropolitan Magistrate only on 16th April, 2018 and had summoned the accused for 23rd July, 2018 when the accused sought personal exemption which was allowed.

Jurisdiction under Article 226 of the Constitution of India cannot be exercised to monitor the progress of the trial before the learned Trial Court and only in case of serious and gross delays and negligence can this Court intervene.

Petition is dismissed with the cost of ₹5,000/- to be paid to the Delhi High Court Legal Services Committee within four weeks. MUKTA GUPTA, J.
