% 31.05.2017 C.M. No. 21738/2017 Exemption allowed, subject to all just exceptions. The application stands disposed of.

LPA 425/2017 and C.M. No. 21737/2017 By the aforesaid application, the appellant seeks condonation of 263 days delay in filing the appeal. We are not inclined to issue notice in the said application since we find no merit in the appeal itself. The learned Single Judge has allowed W.P. (C.) No. 3093/2016 preferred by the respondents by the impugned order dated 05.08.2016 and directed the petitioner to consider the case of the respondents for alternative

allotment of land in lieu of the acquired land. The application of the respondents had been rejected on the ground that there was a delay of six months in making the said application.

Learned counsel for the appellant fairly states that the present case is covered against the appellant by the decision of the Division Bench in Government of NCT of Delhi Thr Secretary Vs. Poonam Gupta, LPA No.190/2015 decided on 08.12.2015.

Accordingly, the present appeal is dismissed following the decision in Poonam Gupta (supra).
