O R D E R

% 04.10.2016 The petitioner impugns the order dated 06.05.2016 whereby his allotment of the General Pool Residential Accommodation has been cancelled and the petitioner is directed to vacate the premises and hand over possession of the quarter. The petitioner also impugns the order dated 19.08.2016 whereby representation has been rejected. Mr. Rajesh Kumar, learned counsel for the respondent, who has appeared on advance notice under instruction from the Director of Estates submits that the allotment of the petitioner has been cancelled and appropriate proceedings would be taken under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971. It is contended that even in impugned orders dated 06.05.2016 WP(C) 9097/2016

& 19.08.2016 it is stated that the action would be taken in terms of the said Act. It is submitted that the petitioner would not be forcefully evicted from the quarter but he would be dealt with in accordance with the said Act. The statement is taken on record. Learned counsel for the petitioner prays for permission to withdraw the present petition with liberty to take such remedies as may be available to him in case any action is taken by the Respondents in accordance with the said Act.

In view of above, the writ petition dismissed as withdrawn with liberty as prayed for.
