% 19.06.2017 CRL. M.A. 9865/2017 (exemption) Exemption allowed, subject to just exceptions. Application stands disposed off accordingly.

BAIL APPLN. 1111/2017 Heard partly.

During the course of hearing it does come to be pointed out that the applicant has been charged for the offences under Section 363/376 IPC, besides Section 6 of the POCSO Act.

At this stage learned counsel for the applicant seeks to withdraw the application to file a fresh application for bail, once prosecutrix is examined before the Trial Court. Keeping in view the fact that the applicant by himself was also aged about 22 years only at the time of alleged commission of the

offences, it is expected of the prosecution to ensure that the prosecutrix is examined at the earliest and trial Court is requested not to give any unnecessary indulgence, which may delay the recording of statement of the prosecutrix.

Application stands disposed off accordingly.
